Acceptance of the Agreement
By selecting “SIGN UP” or “I’m Interested, Tell Me More”, you (“Participant”, “You”, “Your”) agree to the terms, conditions, duties, warranties, and agreements in this document (“Agreement”). If you do not agree, you may not access or use any services, products, or content (“Services”) offered through www.immeksoftech.com (“Website”), owned and operated by Immek Softech Academy.
Courses and Content
When you register, you will gain access to our courseware, practice exams, study materials, and training content related to your chosen course. Content may be in the form of written documents, videos, audio, graphics, or digital formats.
We reserve the right to update, revise, or modify the courseware. Access to new or updated content may require an additional fee.
Using the Website and Its Features
You are granted a limited, personal, non-transferable, non-exclusive, and revocable license to use the Website, Services, and Courseware until either course completion or termination of this Agreement. All materials are provided strictly for your personal, non-commercial learning purposes (“Restricted Purpose”).
You may download or print courseware for study. However, redistribution, resale, public display, modification, or creation of derivative works is strictly prohibited without prior written consent.
Rights to Intellectual Property
All intellectual property rights in the Website, Services, and Courseware belong exclusively to Immek Softech Academy. You are granted only a limited right to use them for learning purposes. This Agreement does not transfer any ownership or proprietary rights to you.
Use of Participants’ Personal Information
We may use your name, image, or video in promotional and marketing materials. We may also contact you regarding upcoming training programs. Your personal data will not be sold or shared with third parties, except when required by law or for verification purposes.
Liability Limitations
Use of the Website and Services is entirely at your own risk. We do not guarantee uninterrupted, error-free operation or absolute accuracy of content. We are not responsible for:
– Delays, errors, or interruptions in service
– Viruses or unauthorized access
– Any direct, indirect, incidental, special, or consequential damages
Our maximum liability will never exceed the amount you paid for the specific course.
Duration and Termination
This Agreement becomes effective when you click “I ACCEPT” and remains valid until:
– Course completion, or
– Termination due to misconduct, misrepresentation, or breach of terms.
In case of default, we may immediately block your access and pursue remedies as per law.
Compensation
You agree to indemnify and hold harmless Immek Softech Academy, its employees, partners, and affiliates against any claims, damages, or expenses arising from unauthorized use of the Website, Services, or violation of this Agreement.
Waiver
Failure to enforce any provision of this Agreement shall not be considered a waiver of rights. A waiver in one instance does not apply to future instances unless confirmed in writing.
Severability
If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions will remain in effect. A valid substitute clause will apply as close as possible to the parties’ original intent.
Law and Jurisdiction in Control
For participants in the USA: This Agreement is governed by the laws of New York, with exclusive jurisdiction of New York courts.
For participants outside the USA: This Agreement is governed by Indian law, with exclusive jurisdiction of the courts of Chennai, India.
Modification and Assignment
We may update or modify this Agreement at any time. Updated versions will be posted on the Website. Continued use of the Services after updates constitutes acceptance of the revised terms.
You may not transfer or assign your rights under this Agreement to others.
Whole Contract
This Agreement, along with our Privacy Policy, Refund Policy, Terms of Use, and Cookie Policy, represents the entire understanding between you and Immek Softech Academy, superseding any prior agreements.
